Creator & influencer agreement

1. Parties and acceptance

This Agreement is between the participating creator or influencer (“Creator”) and Dashuroj SH.P.K, Prishtinë 10000, Republic of Kosovo, operator and publisher of WestKin. A Creator must accept this Agreement before using features that require approved creator status.

2. Eligibility

Creators must be at least 18 years old, maintain a valid WestKin account, provide accurate creator information, comply with WestKin policies, complete any identity, age, tax, or payout verification reasonably required, own or control the rights needed for their content, and receive approval from WestKin.

3. Independent status

A Creator is an independent participant and is not an employee, agent, partner, franchisee, or legal representative of Dashuroj SH.P.K unless a separate written agreement expressly states otherwise. Creators are responsible for their own taxes, registrations, permits, and legal obligations except where law requires otherwise.

4. Creator features

Approved Creators may receive access to creator profiles, Campfire publishing, premium or Trail Pass posts, tips, creator-wallet functions, promotional programs, or other features. Approval does not guarantee access to every creator program or continued availability of any feature.

5. Global and premium content

Creators may be able to designate eligible content for general distribution or premium access. Premium designation does not change WestKin's content rules. Content prohibited in public areas remains prohibited behind Trail Pass or any other access restriction.

6. Prohibited premium content

Trail Pass and other paid-access areas are not pornography marketplaces. Creators may not distribute pornography, graphic sexual acts, non-consensual intimate material, sexual exploitation, sexual services, content involving or sexualizing minors, CSAM, or material prohibited by the Community Guidelines.

7. Ownership and license

Subject to third-party rights, the Creator retains ownership of Creator Content. By submitting Creator Content to WestKin, the Creator grants Dashuroj SH.P.K a non-exclusive, worldwide, royalty-free license to host, store, reproduce, encode, transcode, resize, create previews from, display, distribute, moderate, and otherwise process the content as needed to operate WestKin, provide Campfire and premium access, investigate reports, comply with law, enforce policies, and perform any promotional use separately authorized by the Creator.

8. Third-party rights

The Creator represents that their content does not unlawfully infringe copyright, trademark, music rights, image rights, privacy rights, publicity rights, contractual rights, or other rights of another person. The Creator is responsible for obtaining any consent or authorization legally required for people or third-party material appearing in the content.

9. Creator earnings

Creator status does not automatically create a right to payment. Compensation exists only where WestKin expressly makes a feature or commercial arrangement eligible for creator earnings. Eligible compensation may include creator tips, designated creator-wallet credits, promotional campaign fees, revenue-share arrangements stated in a separate commercial schedule, or other compensation expressly identified by WestKin.

A Trail Pass subscription does not by itself guarantee any particular Creator a share of subscription revenue unless a separate written commercial term says so.

10. Bucks, tips, and creator balances

WestKin may allow users to use Bucks to support or interact with Creators. Internal balances are not bank accounts and do not earn interest. A displayed balance becomes payable in money only when WestKin expressly designates it as eligible creator earnings and all applicable payout conditions are met.

11. Settlement, holds, refunds, and fraud

WestKin may apply settlement delays, minimum payout thresholds, fraud reviews, chargeback reserves, refund adjustments, store-payment adjustments, or compliance holds. WestKin may deduct or withhold amounts associated with refunds, reversals, chargebacks, artificial engagement, self-tipping schemes, coordinated transaction manipulation, stolen payment methods, prohibited transactions, or technical errors.

12. Taxes and payout information

Creators are responsible for taxes arising from Creator Earnings except taxes that applicable law requires another party to collect, withhold, or remit. WestKin may require tax, identity, or payout documentation before enabling or releasing payouts.

13. Sponsorships and advertising disclosures

If a Creator receives money, free products, benefits, discounts, commissions, or another material incentive to promote WestKin or a third party, the Creator must make disclosures required by applicable advertising, consumer-protection, and influencer-marketing laws.

14. Promotional campaigns

WestKin and a Creator may agree to campaign-specific terms covering deliverables, platforms, dates, formats, compensation, brand assets, disclosure language, approval requirements, and promotional usage rights. Those terms may be recorded in a separate Creator Commercial Schedule.

15. Creator conduct

Creators may not harass users, generate fake engagement, buy or sell fraudulent interactions, conduct scams, solicit prohibited off-platform payments, distribute illegal material, publish non-consensual intimate imagery, infringe rights, evade moderation, manipulate transactions, or use creator status to pressure users for romantic, sexual, financial, or other consideration.

16. No entitlement to personal access

Creator status does not create a duty to personally interact with subscribers or supporters. Likewise, Trail Pass access, gifts, or tips do not entitle a user to a reply, private communication, romantic attention, sexual interaction, an offline meeting, private contact details, or any service not expressly offered by WestKin.

17. Moderation and enforcement

Creator Content remains subject to WestKin moderation. WestKin may remove content, disable premium access, reduce reach, suspend posting, freeze balances during investigation, revoke creator status, suspend an account, or terminate participation where reasonably necessary for safety, fraud prevention, legal compliance, store compliance, or enforcement of WestKin policies.

18. Child safety

Creators must not create, upload, solicit, link to, facilitate, or distribute CSAM, grooming, sexualization of minors, sextortion involving minors, child trafficking, solicitation of sexual imagery from minors, or attempts to direct users to such material elsewhere. WestKin may report qualifying material or conduct to appropriate authorities as required by law.

19. Platform compliance and in-app purchases

Creators acknowledge that WestKin is distributed through platforms including the Apple App Store and Google Play. Creator content and monetization must comply with applicable platform rules. Creators may not use WestKin content, profiles, messages, or premium areas to circumvent mandatory in-app payment systems for digital content offered through WestKin.

20. Creator departure and termination

A Creator may stop participating subject to outstanding campaign obligations. When creator participation ends, creator privileges may be removed, premium posting may be disabled, outstanding eligible earnings remain subject to settlement rules, and WestKin may retain financial, moderation, fraud-prevention, or legal records where required or permitted.

21. Confidential information

Non-public information supplied for a campaign, beta feature, commercial arrangement, or creator program must not be disclosed unless authorized or legally required.

22. Changes to creator programs

WestKin may modify creator programs, eligibility criteria, monetization methods, features, payout structures, or program availability. Changes affecting already-earned eligible compensation will be handled under applicable law and the commercial terms in effect for that compensation.

23. Governing law

This Agreement is governed by the laws of the Republic of Kosovo, subject to any mandatory law that cannot be excluded.

24. Entire creator agreement

This Agreement, the WestKin Terms of Service, Privacy Policy, Community Guidelines, and any signed or electronically accepted Creator Commercial Schedule form the agreement governing creator participation. A specific written commercial term controls over this Agreement only to the extent it expressly changes that commercial term.
